Dear Sellers,
The Competition and Consumer Commission of Singapore (CCCS) is responsible for enforcing the Consumer Protection (Fair Trading) Act (Cap. 52A), or CPFTA, which aims to safeguard consumers from unfair trading practices by suppliers in Singapore. This act also grants consumers additional rights concerning goods that do not meet contract standards.
What constitutes an unfair practice under the CPFTA?
In dealings with consumers, suppliers are prohibited from: (i) misleading or deceiving consumers, (ii) making false claims, (iii) exploiting consumers who may be unable to protect their interests or comprehend the nature, terms, or implications of the transaction, or (iv) engaging in any actions prohibited by the CPFTA.
Actions to avoid:
Note: Please consult the Second Schedule of the CPFTA for a detailed list of specific unfair practices.
Understanding Lemon Law
Lemon Law offers consumer protection against defective goods that do not conform to contract terms or fail to meet expected quality or performance standards at delivery. Under the CPFTA, suppliers must repair, replace, reduce the price, or refund defective goods within six months of delivery.
CCCS's Role
The CCCS is authorized under the CPFTA to seek injunctions against suppliers who engage in, or are likely to engage in, unfair practices. Injunctions can also be pursued against those who knowingly assist or enable suppliers in such practices.
Failure to comply with an injunction order may result in fines and/or imprisonment for the supplier. Additionally, any person who refuses to provide information, destroys or falsifies documents, provides misleading information, or obstructs an investigation can face fines up to $10,000, imprisonment for up to one year, or both.
For Inquiries
For more details on the CPFTA, please visit the CCCS website at https://www.cccs.gov.sg/ or contact them by phone at 1800-325-8282.
